Uzturēšanās atļauja

On July 14, 2022, the Cabinet of Ministers adopted amendments to the Regulations of the Cabinet of Ministers of June 21, 2010 No. 564 "Regulations of residence permits", provide for the continuation of the practice started in the conditions of the Covid-19 pandemic - remote acceptance of applications for residence permits and applications of invitations. The amendments are made to maintain the procedure for submitting applications for residence permits and applications of invitations prescribed in the Law on the Management of the Spread of Covid-19 Infection.

It was determined that documents for requesting a repeated residence permit or registering of a residence permit must be submitted electronically or by mail, but in the case of requesting a permit for the first time - by mail, if the foreigner resides in the Republic of Latvia, or to the official electronic address. It is also provided that, in the event of the repeated request for a residence permit or registration of a residence permit, the application may also be submitted by the inviter of the foreigner, if the foreigner does not reside in the Republic of Latvia. There is certain requirement for the inviter - to indicate his/her e-mail address for communication.

Regulations provide that the inviter of the foreigner can only submit the application of the invitation electronically, using an electronic service, or electronically, by confirming the application with a secure electronic signature, if the foreigner is invited by a legal entity or an employer.

The requirement for the inviter to present a personal identification document has been removed from the currently valid regulations, replacing it with identification in the e-service or identification of the e-signer.

Amendments also made clarifications in the list of documents to be attached to the application of the invitation in cases, when employees transferred within the company are invited, as well as clarifications are made in the application form for a residence permit in accordance with the administrative division of the Administrative Territories and settlements established by law.
