In our today’s article we continue to tell, how to act in order to employ a guest worker on the basis of a residence permit, and the invitation would take place without delay.
3 steps to be performed in order to ensure invitation of the foreign labour force for work in Latvia.
- At first, you have to register the place of work with the State Employment Agency on the portal of vacant positions, in order also inhabitants of Latvia would find out about that and could apply for work in your company.
- More detailed information on how to register a vacant position is available on the website of the State Employment Agency.
- The vacant position should not be registered in advance with the State Employment Agency in the case if a high-qualification employee is invited for work, who will request the European Union Blue Card.
IMPORTANT!
- When registering the vacant position, remember that the labour payment that you specify in the application shall correspond with at least the average gross salary in Latvia in the previous year.
- In 2020 the amount of the salary was 1143 euro per month before taxes, thus this will be the minimum labour payment, which should be specified both, in the registered vacant position as well as later on - in the employment contract with a third-country national.
- In case a suitable employee from Latvia has not applied for the position within 10 working days, then the invitation procedure of an employee from the third country can be commenced.
- Secondly, the employer has to arrange an application for A CALL.
- Currently the submission of applications for a call takes place only electronically.
- To the e-mail address pasts@pmlp.gov.lv, you should send an application signed with a safe electronic signature and a list of documents enclosed with it. The list of documents is available HERE. It is important to remember that each enclosed document should be approved with a safe electronic signature.
- Thirdly, afterwards when the Office has approved the application for a call, the employee shall pay the State fee and submit the APPLICATION FOR A RESIDENCE PERMIT, consisting of:
- application for for a residence permit;
- photographs;
- copies of travel documents.
IMPORTANT!
- If a spouse and a minor child or a child being under the guardianship travel together with the employee, they have to submit to the Office in addition the document confirming the kinship
- If an employee travels together with a child without the second parent, then a permit signed by this parent in the presence of the official of the Office or representative office or notarially certified for the child to stay in Latvia shall be submitted to the Office.
Application of a residence permit shall be reviewed within 30 days.
If an employee has arrived to Latvia, the documents for requesting the initial residence permit may be submitted:
- by sending to the e-mail address pasts@pmlp.gov.lv , approving each document with a safe electronic signature,
- or by sending via post as an ordinary, non-registered item, presenting in the application documents their e-mail address and telephone number for communication.
Employees, who stay abroad of Latvia, shall submit the documents for receipt of a residence permit to the representative office of the Republic of Latvia abroad.
When granting a residence permit, also a personal identity number is allocated to the employee, providing more broader rights to receive the services. After staying for a period of five years on the basis of the temporary residence permit, the employee has the right to request a permanent residence permit in Latvia.
